THE FEDERAL GOVERNMENT HAS STRENGTHENED LEGISLATION TO BETTER ENABLE RESERVE FORCE MEMBERS ALSO EMPLOYED IN FEDERALLY REGULATED INDUSTRIES TO BE GRANTED LEAVE FROM CIVILIAN EMPLOYMENT FOR BOTH MILITARY SKILLS TRAINING (MST) AND SUPPORT TO OPERATIONS. AS OF 1 SEPT 19, THE RELATED CLC PROVISIONS WILL COME INTO FORCE.
WHILE OPERATIONAL DEPLOYMENTS HAVE BEEN PROTECTED SINCE 2007, THE NEW PROVISIONS WILL EXTEND JOB PROTECTION TO INCLUDE MST (REF B). MST IS DEFINED AT: HTTPS://WWW.CANADA.CA/EN/DEPARTMENT-NATIONAL-DEFENCE/SERVICES/BENEFITS-MILITARY/SUPPORTING-RESERVISTS-EMPLOYERS/JOB-PROTECTION-LEGISLATION.HTML
RESERVE FORCE MEMBERS SEEKING LEAVE FROM THEIR CIVILIAN EMPLOYER FOR MST OR OPERATIONAL DEPLOYMENTS ARE TO PROVIDE TO THEIR EMPLOYER A LETTER FROM THEIR CO ARTICULATING THE REQUIREMENT AT LEAST FOUR WEEKS PRIOR TO THE START OF LEAVE.
LEAVE, FOR MILITARY PURPOSES, CAN STILL BE DENIED IF SUCH LEAVE WOULD ADVERSELY AFFECT PUBLIC HEALTH OR SAFETY OR WOULD CAUSE UNDUE HARDSHIP TO THE EMPLOYER. HOWEVER, DENIAL OF MILITARY LEAVE IS BY THE MINISTER OF LABOUR. FURTHER INFORMATION CAN BE FOUND AT REF C AND D.
